Trump keeps control of the California National Guard after the decision of the Court of Appeal

Three judges from the United States Court of Appeal for the ninth circuit presented Donald Trump another legal victory over Gavin Newsom on Thursday, declaring himself unanimously in favor of his continuous control over the California National Guard.

But victory can be canceled on Friday because the case returns to the Federal District Court of San Francisco.

In their decision, which you can read here, the judges have effectively accepted the argument of the Trump administration to requisition custody and deploy them to enforce its immigration policies.

“To that of the president this deference, we conclude that it is likely that the president legally exercised his statutory authority under § 12406 (3), which authorizes the federalization of the National Guard when” the president cannot be with regular forces to execute the laws of the United States, “said the decision in part.

The Committee of three judges included 2 people appointed by Trump and one appointed by former president Joe Biden.
