The Supreme Court gives the early thumb to the flight of the power of the Trump Congress

The Supreme Court on Tuesday frozen an order for the decision of a lower court judge that the foreign aid money already approved by the congress is spent. The disturbing decision can report an upcoming embrace of the radical “theory” of the Trump administration that a president can choose to retain appropriate funding.
This gambit, called a pocket cancellation, would leave the president to zero any expenditure approved by the congress which he did not like simply while waiting for the financial year. This is an unprecedented expansion of presidential powers in a kingdom explicitly reserved for the Legislative Assembly.
This time, Trump claimed to retreat billions of foreign aid spending.
Chief judge John Roberts signed the order, further strengthening Trump’s hopes, since the judges on his right have proven to be locks for the administration.
The Court of Roberts has, since the emergence of Trump in politics, has adopted extensions previously somewhat re -employed by presidential power, culminating in the granting of huge sides of immunity against criminal proceedings. He also has, in particular under democratic administrations, federal agencies of the management of the sterilized executive, by channeling all the power of the branch to the president.
Tuesday’s ordinance is also a mark in how Trump’s allies more agreed – both in the courts and in the legislature – have become its second term. Its administration launched the two cancellation packages (requiring a simple majority vote at the Congress) and pocket cancellations (a unilateral administration decision) in its first mandate. But Russ Vought, Trump’s management office and Trump budget director, raised the idea to the second term. This time, a package of attractions adopted the Senate in July with only republican votes, despite the defections of Collins and the representative Lisa Murkowski (R-AK). And the administration is less intimidated by the GAO decision in the face of an increasingly practicing Supreme Court.
A judge of the district court found that the termination of the pocket of $ 4.9 billion in Trump was illegal, writing that “there is no plausible interpretation of the statutes which would justify the billions of dollars which they plan to retain”. The Court of Appeal confirmed its decision last week.
Friday evening, the Supreme Court asked for an answer to its order by its disposal.
