Harvey Weinstein sentenced after a new trial in mixed verdict: live updates

Wednesday, Harvey Weinstein was found guilty of a sexual crime in Manhattan for the second time in just over five years, reaffirming his guilt in the eyes of the legal system.

But a jury of 12 New Yorkers acquitted Mr. Weinstein on another of the charges against him and made no decision on a third. The panel is expected to return on Thursday to continue to deliberate the final charge.

By reaching the mixed verdict, the jury seemed to credit the testimony of an accuser, not to believe the testimony of another and a dead end on that of a third party.

Two of these witnesses – Miriam Haley and Jessica Mann – also testified against Mr. Weinstein during his first trial in Manhattan. The third woman, Kaja Sokola, did not testify during the first trial and was added to the case last year.

Mr. Weinstein, 73, was sentenced to Manhattan for criminal sex and rape in 2020, but was taken over this spring after the initial verdict was canceled by the highest jurisdiction of the state. In a decision of 4 to 3, the Court of Appeal ruled last year that the trial judge should not have given the testimony of women who had accused Mr. Weinstein of sexual assault that did not lead to accusations.

Shortly after this decision, the Manhattan district prosecutor’s office, led by Alvin L. Bragg, decided to go ahead with a new case against Mr. Weinstein, adding another criminal act accusation to the first degree in September. The conviction represents an important victory for Mr. Bragg, who presents himself to his re -election this year.

The new trial began in mid-April and included the testimony of nearly 30 witnesses, including the three accusers around which the prosecutors built the case.

Here’s what you need to know:

  • Three accusers: Weinstein was accused of two criminal sexual chiefs linked to the accusations of Ms. Haley and Mrs. Sokola that he forced them with oral sex in 2006. Ms. Haley, a former production assistant, and Mrs. Sokola, a former model, said that they had met Mr. Weinstein while hoping to set up in the cinema and the television industries. Ms. Mann, who said that she had established a complicated relationship with Mr. Weinstein who was sometimes consensual, said that he had raped her in a hotel room in March 2013.

  • Differences compared to the first test: The biggest difference between the two trials is that additional women, beyond that of Mr. Weinstein, have been accused of attackers, were not allowed to testify this time. In 2020, the judge authorized prosecutors to call several women as witnesses to show a model of poor previous acts. These women spoke to jurors episodes when they said that Mr. Weinstein had sexually assaulted them even if their accusations have never led to accusations.

  • What’s going on after the verdict? After his trial in 2020, Mr. Weinstein was sentenced to California in a case separated from sexual crimes. He risks a 16 -year -old prison sentence. Last August, the Queens district prosecutor, whose office manages the rearrangements of Rikers Island, said that Mr. Weinstein would have returned to California following his New York affair. “He will first purge the Californian penalty because it is now his main sentence,” said Melinda Katz, the Queens district prosecutor.
