The court rejects the prosecution of Preity Zinta against the co -directors Mohit Burman, Ness Wadia

Civil judge Kaushal Kumar Yadav in Chandigarh rejected a civil prosecution filed by Preity Zinta, the film actress and one of the directors of Kph Dream Cricket Private Limited, against the co -directors Mohit Burman and Ness Wadia. In the trial, Zinta prayed to declare the extraordinary general assembly of the company, which took place on April 21, as illegal and invalid. She argued that the meeting had been organized by Mohit Burman with the active support of Ness Wadia in violation and the total contempt for the provisions of the 2013 law on companies, as well as articles of the company.

Zinta also prayed to prevent the company, Mohit Burman and Ness Wadia from giving effect to any resolution that may have been adopted in Reunion and prevent Muneesh Khanna from being or being held as director of the company. However, the main lawyer Anand Chhibbar, assisted by the lawyer Amitabh Tewari, appearing for Ness Wadia, and Nk Nanda, appearing for the company, opposed the pursuit.

Chhibbar argued that the applicant’s application had no merit and was liable to be dismissed, because the court lacked competence inherent in the same thing in the light of article 430 of the 2013 Companies Act. Exclusively within the jurisdiction of the National Court of Companies Law (NCLT).

After having heard the arguments, the court judged that it lacked competence to entertain this action for the express statutory bar contained in article 430 of the law of 2013. The court rejected the complaint under order VII Rules 11 (d) of the Code of Civil Procedure for lack of jurisdiction. However, Zinta had the freedom to continue an appropriate appeal before the NCLT, subject to the conditions prescribed under article 244 of the 2013 law on companies.

Zinta has a 23% stake in KPH Dream Cricket Private Limited, a private limited company incorporated into the 1956 law on companies, which has a franchise on IPL and the cricket team known as Punjab Kings.
