Green card holders have issued a new warning by immigration officials

Customs and the protection of American border (CBP) have issued a warning to green cards holders, recalling legal permanent residents to transport proof of their immigration status at any time.

“Always wear your extraterrestrial recording documentation. Not having them when arrested by federal police can lead to an offense and fines,” CBP wrote on X.

Why it matters

President Donald Trump ordered his administration to withdraw millions of migrants without legal status to fulfill his commitment to mass deportations campaign. The White House argued that anyone living in the country is illegally considered a criminal.

In addition to people living in the country without legal status, immigrants with valid documentation, including green cards and visas, were detained. Nowsweek reported dozens of cases involving holders of green cards and candidates who have been swept away in immigration and customs raids.

What to know

The Office of Homeland Security Statistics estimated that on January 1, 2024, there were approximately 12.8 million permanent legal residents living in the United States.

The requirement for non-citizens to transport registration documents is not new. It comes from article 264 (e) of the Immigration and Nationality Act, which makes the fault of carrying these documents a federal offense.

According to American citizenship and immigration services (USCIS), legal permanent residents who do not comply with these legal requirements are likely to lose their immigration status and can face the elimination of the country.

Green cards holders have the right to silence and request a legal representation in the event of detention. Although proof of status is legally required, individuals are not obliged to answer questions without lawyer.

USCIS also implemented new costs of $ 1,050 for certain requests which were previously free when they were filed as part of a green card case if the case was tried by an immigration court. The costs apply to Form I-131, used to request travel documents such as prior conditional release and form I-765, the job authorization request. The change adds an important financial burden for individuals who sail in the judicial system while looking for a legal permanent residence.
