“Even” good Hombres “are not safe” – Mother Jones

Today, a federal judge of the Court of Appeal in California has reprimanded the Trump administration for its zealous expulsion policy and to “tear a family”. Judge Stephen Reinhardt from the 9th Circuit Court of Appeals concluded that he did not have the power to stop the withdrawal of Andres Magana Ortiz, but nevertheless took the time to write a brief opinion which denounced his expulsion as “inhuman”.
“We are unable to prevent the abolition of Magana Ortiz, but it is contrary to the values of this nation and its legal system,” wrote Reinhardt in a six -page concordant opinion. “Indeed, the government’s decision to withdraw Magana Ortiz decreases not only our country, but our courts, which are supposed to be dedicated to the pursuit of justice … I agree as a judge, but as a citizen, I do not.”
As Reinhardt detailed it in his opinion, Magana Ortiz came to the United States of Mexico 28 years ago, built a family and a career and paid for his taxes. His wife and three children are American citizens. His only legal transgressions were two dui, the last one 14 years ago. “”[E]The government has conceded during the immigration procedure that there was no question about the good moral nature of Magana Ortiz, “noted Reinhardt. However, in March, the government decided to refuse Magana Ortiz’s request for a stay to move while it asked for the status of legal residence, a process that is still underway and has moved to deport it to Mexico.
Reinhardt has particularly targeted the fact, demonstrated several times during the first months of the presidency of Donald Trump, that the repression of the immigration of the administration does not only target violent criminals. “President Trump said his immigration policies would target” bad hombres, “he wrote. “The government’s decision to withdraw Magana Ortiz shows that even” good hombres “are not safe.
