Erik Menendez was diagnosed with a “serious medical condition,” his lawyer told several American media.
The news comes from weeks before he and his brother, Lyle, should appear during a parole hearing after spending decades in prison for the murders of their parents.
The lawyer did not provide more details on the medical condition. The BBC asked for comments.
Menendez was taken from a San Diego prison, in which he has been detained for years, in an outdoor medical establishment on Friday.
The Department of Correctional Services and Rehabilitation of the State of California told Local Outlet CBS 8 that Menendez was in “fair condition”, but that it could not give more details.
The brothers, who have been behind bars for 35 years, were sentenced in May to 50 years in life for the murders of Kitty and José Menendez, in 1989.
They previously served life without the possibility of parole.
But earlier this year, a Los Angeles judge determined that Erik, 54, and Lyle, 57, did not put any “unreasonable risk” if they were released. The judge added that the brothers had “done enough” in prison to deserve a change of sentence.
The new sentence of the pair made them eligible for a consideration of parole because of their young age when their crimes were committed.
The lawyer for the brothers Mark Geragos called for the release of Erik Menendez in an interview with TMZ, referring to the health of his client.
“I just think he should be on leave of theatole, I think it is the appropriate term, and it could be medically known before the hearing so that he can work with the lawyer for parole and get ready and be ready and give it and give his best,” said Geragos. “I think it’s the only fair and fair thing to do.”
The brothers’ parole hearing is scheduled for August 21.
The couple underwent two trials before being sentenced in the 1990s. They said that the murders were in self-defense. Prosecutors argued that the brothers were spoiled young men who killed their parents for financial purposes.
