Important advice: new travel restriction for H-1B visa holders
Hi all – We have now examined the real text of today’s presidential proclamation on H -1B visas, which you can find here: restriction at the entrance of certain non -immigrant workers – the White House.
Here is what you need to know:
First, the proclamation is structured as a travel restriction. From 12:01 p.m. Eastern time, on September 21, 2025 (so 9:01 p.m. Pacific time tomorrow), individuals will not be able to enter / return to the United States in H-1B status unless their petition has an additional payment of $ 100,000.
What you need to do:
I will update this post later in the evening with a form that people can fill out if they are currently outside the United States with an H-1B visa. We want to be able to follow each individual and provide support and advice as they try to return in the next 28 hours.
The proclamation did not affect any other visa status.
There are other content regarding the break in the treatment of H-1B petitions for people who are outside the United States at the moment, we do not interpret this to immediately have an impact on the extensions of H-1B status or status changes in H-1B as long as you are currently in the United States, we will share it more about it later.
